Welcome to NoahGuy. These terms and conditions (“Terms”) apply to everyone who visits noahguy.co.za (the “Site”), searches for a tradesperson, or lists a business on it. NoahGuy is operated by NoahGuy (Pty) Ltd (“NoahGuy”, “we”, “us”). By using the Site or creating an account you agree to these Terms. If you do not agree, please do not use the Site.

1. What NoahGuy is

NoahGuy is an online directory that helps homeowners and businesses in South Africa find tradespeople (“Providers”) such as plumbers, electricians, carpenters, painters and handymen. We provide the platform where Providers advertise their services and where visitors can contact them. NoahGuy is not a party to any agreement between a visitor and a Provider. We do not supply the trade services, we do not employ Providers, and we do not guarantee the quality, safety, timing or price of any work.

2. Using the Site

• You must be at least 18 years old and able to enter into a binding agreement.
• Keep your account details accurate and your password private. You are responsible for activity on your account.
• Do not misuse the Site. That includes posting false or misleading information, impersonating another person or business, scraping or copying listings in bulk, sending spam, or attempting to interfere with the Site or its security.

3. Provider listings

If you list your business on NoahGuy you confirm that:

• the information you provide (business name, services, areas served, contact details, images and descriptions) is true, accurate and kept up to date;
• you are legally allowed to offer the services you advertise, and you hold any registrations, licences or certificates the work requires (for example, an electrical Certificate of Compliance where the law requires one);
• you own, or have permission to use, every image and piece of text you upload; and
• you will deal with customers honestly and comply with South African law, including the Consumer Protection Act, 68 of 2008.

Every new listing is reviewed before it goes live. We may decline, edit, unpublish or remove any listing, and suspend or close any account, that breaches these Terms or that we reasonably believe is misleading or harmful. A listing being live on NoahGuy does not mean we have inspected, licensed or endorsed the Provider.

4. Plans, fees and payment

NoahGuy offers a free listing plan and a paid Pro Listing plan. The price of each plan is shown on the Post Your Business page and at checkout. At the time of writing the Pro Listing is R99 per month. All prices are in South African rand (ZAR).

• Automatic monthly renewal. When you buy a paid plan you authorise us, through our payment provider Paystack, to save your card details securely and to charge the plan price to that card every month until you cancel. We do not see or store your full card number.
• Reminders. We email you a few days before each renewal so there are no surprises.
• Failed payments. If a renewal fails we will tell you and try the card again over the following days. If the payment is still unsuccessful after about seven days your listing is paused (hidden from the Site). It goes live again automatically once payment is received. We may also pause listings that remain unpaid.
• Price changes. If we change the price of a plan we will give you at least 30 days’ notice by email before the change applies to your next renewal.
• Cancelling and refunds are explained in our Refund and Cancellation Policy, which forms part of these Terms.

5. Content you post

You keep ownership of the content you post. By posting it on NoahGuy you give us a free, non-exclusive licence to display, store and promote it on the Site and in our marketing for as long as your listing is active, so that we can operate the service.

6. Our content and intellectual property

The NoahGuy name, logo, design and the Site’s software and text belong to us or our licensors. You may not copy or reuse them without our written permission.

7. Reviews and communication between users

Reviews and messages must be honest, relevant and respectful. We may remove content that is abusive, defamatory, fake or unlawful. Any agreement for work, including price, scope and payment, is made directly between the visitor and the Provider. We recommend that you get a written quote, check credentials and agree the details before work starts.

8. Availability

We work hard to keep the Site running, but we do not promise that it will always be available or error-free. We may change, suspend or improve features from time to time.

9. Limitation of liability

To the fullest extent allowed by law, NoahGuy is not liable for any loss or damage arising from the work, conduct, advice or omissions of any Provider or visitor, from reliance on information in a listing, or from interruptions to the Site. Nothing in these Terms limits any right you have under the Consumer Protection Act or any other law that cannot be excluded. Where our liability cannot be excluded, it is limited to the amount you paid us in the three months before the claim.

10. Privacy

How we handle personal information is explained in our Privacy Policy.

11. Ending your account

You can stop using NoahGuy at any time. You can ask us to close your account by emailing support@noahguy.co.za. We may suspend or close an account if these Terms are breached.

12. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they were last changed. If a change is material we will notify Providers by email. Continuing to use the Site after a change means you accept the updated Terms.

13. Governing law and contact

These Terms are governed by the laws of the Republic of South Africa. Questions about them can be sent to support@noahguy.co.za. Billing questions can be sent to billing@noahguy.co.za.
